Risk Disclosure

This Risk Disclosure (“Disclosure”) applies to your use of the VSmarket platform (“VSmarket”, “we”, “our”, or “us”). By accessing or interacting with VSmarket, including browsing, creating, or joining challenges, you acknowledge that you fully understand and accept the risks described below. If you do not agree, you must discontinue all use of the platform.
1) Smart Contract, Blockchain & Technical Risks
VSmarket operates entirely through smart contracts deployed on public blockchains. Smart contracts may contain bugs, vulnerabilities, or unintended behavior that could result in loss of funds. Transactions are irreversible once confirmed, and no party—including VSmarket—can reverse, cancel, or modify them.
The protocol is designed for a specific network and token set (for example Base and a specific USDC token). If you attempt to interact with the wrong network or asset, transactions may fail or revert.
- Unexpected smart contract behavior or upgrade-related issues
- Chain reorganizations, forks, or consensus failures
- Network congestion causing failed or delayed transactions
- Incorrect gas settings resulting in stuck or expired transactions
- Exposure to exploits, including but not limited to re‑entrancy and economic attacks
You are solely responsible for understanding how blockchain interactions work, including wallet signatures, gas fees, and the implications of broadcasting on-chain transactions.
2) Financial Risk & Loss of Funds
Participation in challenges involves staking funds at your own risk. You may lose some or all of your stake due to:
- Losing a challenge based on skill performance
- Failure to submit proofs within required time windows (silence window)
- Timeout settlement if nobody submits proof (no-proof cancel window may apply)
- Counterproofs that overturn outcomes
- Disputes resolved against you
- Smart contract or blockchain-related failures
VSmarket provides no insurance, guarantees, refunds, or compensation of any kind, beyond what the deployed smart contracts enforce automatically.
In some edge cases, the smart contract may settle a contest via a timeout path (for example if nobody submits any proof). Such outcomes still follow the contract’s rules and may include protocol fees and stake splitting.
2bis) User Responsibility & Human Error
You acknowledge that losses may occur due to user error, including but not limited to misunderstanding challenge rules, sending funds to incorrect addresses, interacting with unintended contracts, or misusing wallets and signing requests.
VSmarket is not responsible for losses resulting from user mistakes or misunderstandings of how the platform or blockchain transactions operate.
3) Proof System, Disputes & Outcome Uncertainty
VSmarket uses a proof submission and proof‑of‑silence mechanism. After a proof hash is submitted, the other participant has a limited silence window to contest. If the proof remains uncontested within that window, anyone can finalize and the on-chain contract allocates the stake — final and irreversible.
Disputes may arise due to:
- Misinterpretation of rules
- Inaccurate or incomplete evidence
- Bad‑faith actors or fraudulent submissions
- Disconnections, lag, or technical interruptions
If nobody submits any proof, a contest may still be resolved after a separate no-proof cancel window. Once that window elapses, the contract may allow anyone to cancel the contest via a timeout path.
- Protocol fees may still apply to the stake pool
- Stake may be split between participants
- Deposits may be refunded depending on the contract’s settlement path
In addition, dispute admins can generally only resolve a contest after a proof is submitted, and may be unable to bypass timing constraints while a contest remains active.
VSmarket does not independently verify any user-submitted material and is not responsible for the authenticity, accuracy, or fairness of evidence. You accept that dispute resolution is limited strictly to platform mechanisms.
3bis) No Verification, No Guarantee of Fairness
VSmarket does not verify, validate, or authenticate user-submitted proofs, counter-proofs, outcomes, identities, or skill levels. All challenges are user-defined and peer-to-peer.
VSmarket does not guarantee fair play, equal skill, honest behavior, or accurate representation by participants.
4) Third‑Party Platforms & Infrastructure
Challenges may involve independent third‑party platforms, games, services, or infrastructure. VSmarket is not affiliated with, endorsed by, partnered with, or sponsored by any third‑party platform referenced in user challenges.
VSmarket does not own, operate, license, or claim any rights over third‑party platforms, games, brands, or services on which challenges are based.
- Service outages or shutdowns
- Account suspensions or bans
- Game rule changes, patches, or anti‑cheat false positives
- Regional restrictions or platform‑level disputes
You must comply with all third‑party terms and are solely responsible for verifying their legality and availability.
5) Regulatory & Legal Risk
Laws regarding decentralized platforms, digital assets, staking, and online competitions vary widely by country and may change unexpectedly. Your use of VSmarket may become restricted or prohibited at any time without notice.
- Regulatory actions may impact access or functionality
- Use may be illegal in your jurisdiction
- Tax reporting obligations are your responsibility
- VSmarket does not offer legal or compliance advice
5bis) No Gambling, Betting, or Wagering Services
VSmarket does not operate gambling, betting, or wagering services. Challenges represent peer‑to‑peer interactions based on user-defined skill criteria.
Any classification of challenges under applicable laws is your sole responsibility.
6) Self‑Custody & Wallet Security
VSmarket does not hold custody of any funds or private keys. You are fully responsible for securing your wallet, seed phrases, and access credentials.
- Loss of private keys results in permanent loss of access
- Phishing, malware, or compromised devices may lead to theft
- Approving malicious contracts may expose funds
Never share seed phrases or sign transactions you do not understand.
7) No Guarantees of Performance or Availability
VSmarket is provided on an “as is” and “as available” basis. We do not guarantee:
- Platform uptime or uninterrupted access
- Accuracy or reliability of displayed information
- Availability of features or regional access
- Timely processing of on‑chain events
7bis) Frontend, API & Indexing Limitations
Displayed information such as balances, challenge status, timers, outcomes, or USD values may be delayed, inaccurate, or incomplete due to indexing delays, caching, RPC failures, or frontend limitations.
The blockchain state is the sole source of truth. VSmarket is not responsible for decisions made based on displayed data that differs from on‑chain reality.
In rare cases, a token transfer (payout or refund) can fail due to token-specific transfer restrictions. When that happens, funds may become claimable and require an additional on-chain transaction to withdraw.
8) Market, Volatility & Economic Risks
Staked assets may fluctuate in value due to market volatility. You may experience:
- Value loss unrelated to challenge outcomes
- Gas fees exceeding expected amounts
- Slippage or liquidity constraints on external markets
9) Data, Privacy & Public Transparency
Your blockchain activity is publicly visible and permanently recorded. VSmarket does not require identity verification, but external services (wallets, RPC providers, IPFS gateways, analytics tools) may process data under their own policies.
You are responsible for reviewing third‑party privacy terms.
9bis) User Content & Legal Compliance
You are solely responsible for all content you submit, including proofs, counter‑proofs, text, links, images, and videos.
Content must not infringe intellectual property rights, privacy rights, or applicable laws. VSmarket assumes no responsibility for user‑submitted content.
10) No Financial, Legal, or Tax Advice
Nothing on VSmarket constitutes financial, legal, or tax advice. You should consult qualified professionals before making decisions involving digital assets or participation in skill‑based competitions.
11) Emergency Pause & Incident Response
VSmarket smart contracts may include an emergency pause mechanism. If the protocol is paused, many actions can be temporarily disabled — including creating/joining challenges, submitting proof or counter-proof, finalizing contests, and timeout cancellation.
If a pause occurs, your funds are still governed by the smart contract, but you may be unable to take certain on-chain actions until the protocol is unpaused.
Limitation of Liability
To the maximum extent permitted by law, VSmarket shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, reputation, or opportunity.
VSmarket’s total aggregate liability shall not exceed the protocol fees collected in connection with your activity.
Final Acceptance
By continuing to use VSmarket, you confirm that you understand and accept all risks described in this Disclosure. If you do not agree, you must stop using the platform immediately.
